An inmate at the Floyd County Jail no doubt felt that he’d been given an early Christmas present, when he was released from jail the day before Thanksgiving.
The problem was – it was a mistake.
50 year old Frank Nixon had been sentenced earlier in the week to 10 years in prison followed by 10 years probation on a felony theft by shoplifting charge, however his sentence had accidentally been listed as 10 years probation only, so – he was released from custody.
Once deputies realized their mistake, they went to the address listed for Nixon, where they found him sitting on his front porch – seemingly quite content.
Nixon has since had a charge of escape filed against him; Deputy Chief Tom Caldwell stated that Nixon should’ve known he had 10 years of time to serve, but decided to walk out of jail anyway.
