Two High-Profile Trials in DeKalb County Postponed

DCSO - Westbrook 2Two high-profile trials that were scheduled to begin Tuesday (September 10th) in DeKalb County – have been postponed.

District Attorney Mike O’Dell told the Ft Payne Times-Journal that the trials of both Patty Elaine Westbrook and Kelly Jack Mayo, have been postponed, due to psychological evaluations still not being complete.

After the evaluations have been completed the cases are scheduled to be placed on the docket for trial.

Westbrook had entered a not guilty plea in June last year (2012), to capital murder in the death of Charles Batey.  Her charge had initially been attempted murder, after allegedly shooting Batey in the chest during an attempted armed robbery in March 2011; Batey died about three months after the incident, due to the injuries he sustained during the assault.  The charges were then upgraded.

DCSO - MayoMayo allegedly fired rounds into the Fred’s store in Rainsville in August of 2012 causing serious injury to two store employees; he was eventually arrested in Cedartown Georgia – after allegedly entering another Fred’s store, and taking an employee hostage.  He managed to flee the store, but was apprehended a short time later without incident.

His charges included felony armed robbery, felony kidnapping, two counts of aggravated assault, and two counts of false imprisonment in Georgia.  He was extradited back to Alabama to face the charges here in connection with the Rainsville shooting.

Law enforcement eventually managed to match Mayo’s .45 caliber handgun with the casings that were recovered from the Fred’s store in DeKalb County.

Mayo is looking at 34 years to life in prison if convicted here.
