A DeKalb County woman accused of killing an elderly man will go to trial September 9th.
Patty Westbrook is charged with capital murder in the shooting death of 74-year old Pete Batey.
Investigators say Mr. Batey was shot on March the 5th of 2011 during an attempted robbery following a trip to a gas station in downtown Geraldine.
Police say Westbrook approached Mr. Batey and asked him for a ride.
He agreed.
Westbrook told Batey to pull over near Macedonia Baptist Church, where she shot him in the chest and drove off in his truck.
Westbrook was arrested the next day and was initially charged with Attempted Murder, but those charges were upgraded when Batey died a little over two months later.
Westbrook pleaded not guilty by reason of mental disease or defect in 2012.
