Alabama Plans Nitrogen Hypoxia Execution in March

MONTGOMERY, Ala.– The Alabama Department of Corrections announced Thursday that an execution date has been set for death row inmate Charles Lee Burton.

According to a media advisory issued February 26, 2026, the Alabama Supreme Court has ordered Burton’s sentence to be carried out by nitrogen hypoxia. The execution is scheduled to begin at 12:00 a.m. Thursday, March 12, 2026, and will expire at 6:00 a.m. Friday, March 13, 2026.

Burton was sentenced to death in 1991 for the murder of Doug Battle in Talladega County. Court records show he was convicted of the 1991 killing in Sylacauga.

The execution will take place at the William C. Holman Correctional Facility in Atmore. State law limits the number of media witnesses to five. Those witnesses will be selected from credentialed reporters representing outlets within the county of conviction, which is Talladega County. If fewer than five media representatives are available from that county, the Department of Corrections will select additional witnesses by random draw.

All other members of the media will be directed to a media center, where department officials will provide statements following the execution. Media representatives attending in person are required to wear business professional attire with stable footwear for safety reasons.

Alabama has used nitrogen hypoxia as an execution method in recent cases as part of its capital punishment protocol.
