MONTGOMERY– Benjamin Adam Nowell will continue serving life without parole after the Alabama Court of Criminal Appeals upheld his capital murder conviction. Nowell, 39, of Dothan, received that sentence for the 2022 killing of Brittany Phillips in Houston County.
Alabama Attorney General Steve Marshall announced the ruling, which the court issued Oct. 30, 2026.
According to Marshall’s office, Nowell followed a vehicle carrying Phillips and a man to the end of Knowles Drive in Webb. Nowell then fired one shot, killing Phillips, his former girlfriend, early on July 7, 2022. The day before the shooting, Nowell had left a prison work-release program. Authorities searched for 12 hours before capturing him near the scene.
Houston County District Attorney Russ Goodman prosecuted the case. A jury found Benjamin Adam Nowell guilty of capital murder in 2025. He later appealed the conviction. The attorney general’s Criminal Appeals Division then defended the verdict and asked the court to uphold it.
Afterward, Marshall commended Assistant Attorney General Steve Dodd for his work on the appeal. Marshall also thanked Goodman and his staff for their work on the case.
