The driver, identified as Levi Michael Brown, age 28, of Menlo, submitted to Preliminary Breath Testing resulting in a positive reading for alcohol on his breath.

Trooper Mosley stated “While speaking with Mr. Brown, I could smell the odor of an alcoholic beverage emitting from his person, and his eyes were bloodshot and watery. Mr. Brown stated that he had been in Rome and only had two India Pale Ale beers.”
