Weiss Lake Shoreline Permit Renewal Opens for Public Comment

WEISS LAKE– Waterfront property owners have until Nov. 14 to comment on a Georgia water-quality review tied to proposed dock, shoreline, and dredging permits.

The Georgia Environmental Protection Division issued the notice Thursday, Oct. 15. It specifically includes approximately 11 miles of Weiss Reservoir extending into Georgia.

The U.S. Army Corps of Engineers, Mobile District, is seeking certification for proposed 2027–2032 Alabama Power Company Programmatic General Permits. The package contains seven categories covering routine work within Alabama Power reservoir boundaries.

However, the notice opens a review process. It does not announce final approval or direct every existing dock owner to reapply.

What the Proposed Permits Cover

The broader Corps proposal concerns Alabama Power reservoirs in the Coosa, Tallapoosa, and Black Warrior river basins. It also extends into Georgia along the Weiss Reservoir portion identified in the notice.

The seven proposed permit categories cover:

  • Debris removal for navigation or drainage purposes.
  • Dredging for new noncommercial boat slips and maintenance dredging of existing slips, canals, or navigation channels.
  • Construction or maintenance of fixed and floating structures, including residential docks and piers.
  • Construction or modification of water-access structures and ramps.
  • Shoreline stabilization, including riprap, bulkheads, and other qualifying protection measures.
  • New navigation-channel dredging.
  • Filling certain previously dredged areas, such as boat slips and artificial canals.

According to the Corps, general permits streamline review for categories of work with minimal individual and cumulative environmental impacts. Every five years, the Corps reviews these permits and then decides whether to renew or modify them.

The accompanying documents list Jan. 9, 2027, as the current program’s expiration date. Under the replacement proposal, the program would run through Jan. 9, 2032.

Georgia’s Review Focuses on Water Quality

The October notice concerns Section 401 of the federal Clean Water Act. This review gives Georgia an opportunity to examine whether activities covered by the federal permits would meet applicable water-quality requirements.

According to the U.S. Environmental Protection Agency, federal permits for activities that may discharge into regulated waters generally require certification or a waiver. Certifying authorities may then grant certification, impose conditions, or deny a request.

For this comment period, Georgia EPD says it will consider only comments pertaining to water quality.

That distinction also separates the current review from an earlier Corps comment period. The Corps first advertised its proposal Sept. 8 and closed that comment period Oct. 9. However, Georgia’s separate water-quality comment period remains open through Nov. 14.

What Property Owners Should Understand

For proposed work, Alabama Power’s site manager would still review projects for coverage under the general permits. Some projects would still require direct Corps review or another form of authorization.

The draft also requires project-specific written verification before regulated work begins. Simply fitting a general description, such as a dock or boat ramp, would not automatically authorize construction.

For existing improvements, the draft says activities completed under valid permits continue to hold authorization unless officials take case-specific action. Therefore, the five-year program renewal should not be read as a blanket instruction for every owner to submit a new application.

Separately, Alabama Power’s current shoreline permit guidance directs owners planning repairs, construction, or modifications in the lakebed or its flood easement to begin the permitting process. The company also makes clear that submitting an online request does not itself issue a permit.

Property owners should discuss their particular project and existing authorization with the shoreline office before scheduling work.

Proposed Limits and Environmental Protections

The draft contains specific limits for different kinds of projects.

For example, its boat-slip and maintenance-dredging category covers less than 500 cubic yards of material. The separate new-channel category also allows up to 500 cubic yards, subject to navigation-depth and other restrictions.

In addition, the water-access and ramp category would allow less than 250 cumulative cubic yards of dredging or filling below the ordinary high-water mark. Projects involving both activities must count the combined amount toward that limit.

The fixed-and-floating-structure category covers noncommercial residential structures. It would also allow in-place maintenance of existing commercial structures, subject to the permit’s conditions.

The proposed conditions also address erosion control, sediment containment, wetlands, protected species, and historic resources. Dredged material generally must go to a confined upland area where sediment cannot wash back into the waterway.

These are proposed federal permit provisions. Final certification conditions and project-specific requirements will determine what work can proceed.

How to Submit Comments

Georgia EPD will accept water-quality comments through Nov. 14, 2026.

Email comments to EPD.WQC@dnr.ga.gov. Include “Water Quality Certification Comment” and the control number “SAM-2026-00633-LET et al.” in the subject line.

Residents may also mail written comments to:

Program Manager, Wetlands Unit
2 Martin Luther King, Jr. Dr. SE
Suite 1052 East
Atlanta, GA 30334

For mailed submissions, place the same wording and control number at the top of the first page.

The notice lists Dewey Richardson at dewey.richardson@dnr.ga.gov for additional information about the certification review.

For individual shoreline-project questions, Alabama Power’s current contact page lists its Weiss Lake office at 256-407-6008. The office email is WeissLakeShorelines@southernco.com.

The complete EPD notice and supporting Corps documents are available online for residents who want to review the proposed conditions before commenting.
