Attalla Man Found Guilty of Capital Murder in Slaying of Wife

Roy Thomas “Tommy” Smith will face spending the remainder of his life behind bars after being found guilty of killing his wife.

An Etowah County jury has found the 57 year old guilty of Capital Murder – in the slaying of his wife, Carla, back in 2010.  He was indicted in June of 2011.

Paramedics found her body in the trunk of her car on November 1st of that year and investigators say Smith abandoned the vehicle in the parking lot on Pump Station Road/Brooke Avenue before leaving in his own car.  She had died of strangulation.

Prosecutors introduced evidence pointing to Smith having a history of violence including striking his wife and leaving bruises and black eyes; Smith’s attorney on the other hand, claimed much of the evidence presented was irrelevant focusing on evidence that really had no bearing on the case – such as photos taken from the home and Smith’s hunting camp in Cherokee County.

District Attorney Jimmie Harp says the state will not seek the death penalty; Roy Smith could be facing life in prison without the possibility of parole.

A sentencing hearing has been set for April 17th.
